Terms of Sales

Article 1: Scope - general provisions

These general conditions of sale apply to all orders for products made on the website www.futonzen.com, commissioned intermediary for the sale of the sole proprietorship BERNARDO CORVI  whose registered office is located at Borgo dei Segantini, 8 - 43037 Lesignano de 'Bagni (PR) - Italy.

 

In these General Conditions of Sale, the following words will have the following meanings:

the term “the Customer” designates any person visiting or making a purchase through the website www.futonzen.be;

the term "the Company" means the BERNARDO CORVI company;

the term “the Products” designates the products offered by the site www.futonzen.be and supplied by Il Fiore d'oriente di BERNARDO CORVI  to the Customer;

the term "the Site" designates the website www.futonzen.be

 

The online sale of the Products presented on the Site is reserved for User Customers, excluding traders, wholesalers and resellers who wish to resell these same products to third parties. Any purchase transaction is regulated according to the provisions of Legislative Decree n.185 / 99 (execution of directive 97/7 / CE relating to consumer protection in the context of mail order sales) as well as those of Decree n. 196 of June 30, 2003 (Single text on the confidentiality of personal data).

 

Article 2: Acceptance of the General Conditions of Sale

The Customer declares to have read the General Conditions of Sale and to have accepted them by checking the box "I accept the General Conditions of Sale" before implementing the online ordering procedure. These General Conditions of Sale shall prevail over all other conditions appearing in any other document, except for prior, express and written exemption. The General Conditions of Sale are accessible at any time on the Site.

 

Article 3: Order - price - availability

Orders are placed by the Customer at the price indicated on the Site when the Customer confirms his order. The prices of the Products displayed on the Site are indicated in euros all taxes included, shipping and insurance costs for shipments to Europe included.

 

An additional contribution may be requested for shipments outside Europe (including overseas departments and territories). Any specific local taxes (customs duties, Sea dues, etc.), remain the responsibility of the Customer.

 

The Products offered on the Site are handmade on demand. Before confirming his order, the Customer will view a summary of the latter with the description and the unit cost of each preselected Product, as well as the total cost in the case of an order of several Products. Following the placing of the order, and before payment, the Customer will receive an e-mail confirming the registration of the order, in which will appear a summary of the order as well as its number. Following acceptance of payment, the Customer will receive an order validation email which will confirm the start of the preparation procedure. The Company reserves the right to cancel an order in the event of fraudulent use of means of payment and / or fraud at the expense of the Company.

 

Article 4: payment

Orders are paid by payment card (bank card, credit card) online. Payments made on the Site are completely secure.

The payment card details provided when ordering are never transmitted unencrypted over the network: they are encrypted using SSL (Secure Socket Layer). The security of data transmission is thus guaranteed in accordance with the banking procedures in force. PLEASE NOTE: the debit from the Customer's account takes place when the order is confirmed.

 

Article 5: delivery

The Products are delivered to the delivery address that the Customer has indicated during the ordering process. All the times announced are calculated in working days (Monday to Friday excluding Saturday, Sunday and public holidays) and subject to confirmation of the order.

 

Except in special cases (out of stock or force majeure), deliveries are made within a maximum period of 15 working days in Europe, from the validation of the order. For any shipment outside Europe (including overseas departments and territories), the maximum deadline is 25 working days.

 

The delivery can be split without this being the responsibility of the Company. In order to guarantee perfect packaging, the packages are wrapped in transparent film and sealed with adhesive tape.

The Customer is required to check the conformity of the goods delivered at the time of delivery and before signing the receipt from the service provider responsible for delivery. The Customer must indicate on the delivery slip and in the form of handwritten reservations accompanied by his signature any anomaly concerning the delivery. This verification is considered to have been carried out as soon as the Customer, or a person authorized by him to sign the receipt. If at the time of delivery, the original packaging is damaged, torn or opened, the Customer must then check the condition of the Products. If they have been damaged, he must absolutely refuse the package and note a reservation on the delivery slip (package refused because open or damaged).

 

Article 6: Disputes and guarantees

The Products ordered on the Site benefit from the guarantee of conformity in accordance with Legislative Decree no. 24 of February 2, 2002 (on sales contracts and guarantees for consumer goods) and with the provisions of the Italian Civil Code. These guarantees apply to Products which present defects of conformity and / or malfunction that cannot be detected at the time of receipt of the delivery, provided that these Products are correctly maintained and used in an adequate manner, in accordance with the instructions in the instructions for use. Warranty exclusions Any warranty is excluded in the event of improper use, negligence or lack of maintenance on the part of the Customer, as in the event of normal wear and tear of the property, accident or force majeure. The Company's warranty is limited to the replacement or reimbursement of non-conforming Products or those affected by a defect. Any warranty is excluded for apparent defects that the Customer has had the opportunity to detect during delivery in accordance with Article 5. In the event that a Product is effectively the subject of this warranty, the Customer may make a claim. contacting the Company within 10 working days from the date of delivery. Only the Company is authorized to determine whether the anomaly is covered by the warranty, and may replace non-conforming Products and reserves the right to verify the actual defect noted by the Customer and to carry out the substitution only after this check. Before any procedure for returning defective Products to the Company, the Customer will send an e-mail to futonzen@gmail.com which will indicate the nature of the goods to be delivered and will provide a description of the observed failure. He will then receive by return e-mail the information necessary to be able to benefit from the guarantee. If this order of the warranty support procedure is not followed, the repair / replacement times could be significantly extended. The Customer will return the Product (s) in suitable packaging and will enclose: a letter specifying: the number and date of the order, a description of the defect observed; a copy of the invoice or purchase receipt. The return costs as well as the shipping costs (shipping and insurance) of the new delivery (new products or repaired products) are the responsibility of the Customer.

 

Article 7: Right of withdrawal

In accordance with Italian law, according to the texts regulating mail order sales, the Customer has the right of withdrawal.The Company accepts without reservation the return of Products provided that they are intact, clean and packaged correctly in their original packaging. Return costs are the responsibility of the Customer. The Customer has 14 working days from delivery (article 3) to exercise his right of withdrawal and have the possibility of returning the Products. The Company then undertakes to reimburse in full the amount of the Products ordered (excluding shipping costs). In the return package, the Customer will enclose a copy of the delivery slip. Article 8: Protection of personal data

All the personal information that the Customer is required to provide for the use of the services of the Site, are used in order to fulfill the obligations related to the purchase-sale contract between the Customer and the Company and are subject to the provisions and Community regulations in force. The Customer has, in accordance with article 7 of Legislative Decree no. 196 of June 30, 2003, a right of access, modification, rectification and deletion of data concerning him. To exercise this right, the Client must write to the Company's head office.

 

Article 9: Incidents and force majeure

The Company cannot be held liable in the event that the non-performance of its obligations is attributable either to the unforeseeable and insurmountable fact of a third party to the contract, or to a case of force majeure (non-exhaustive list): state emergency; natural disaster (earthquake, storm, floods, mudslide, fire, etc.) bad weather; strike; revolution, war, attacks; epidemic; malfunction or interruption of national or international communication channels, national or international postal services. Article 10: Applicable law and competent courts These General Conditions of Sale are subject to Italian law. In the event of a dispute, jurisdiction is declared in accordance with EC Regulation n. 44/2001.
